1. Introduction
This Payment and Refund Policy ("Policy") governs all payments, subscriptions, and refunds related to the Chatseeker platform ("Service").
All capitalized terms not defined herein shall have the meanings set forth in our Terms of Service.
2. No Free Trial
Chatseeker does not offer a free trial.
Access to the Service requires a paid subscription plan unless Chatseeker expressly agrees otherwise in writing.
3. Payment Processing
Payments are processed through third-party payment providers, including but not limited to:
- Stripe
- card networks (Visa, Mastercard, etc.)
- digital payment methods (Apple Pay, Google Pay, etc.)
4. Payment Security and Personal Data
Payment processing is handled by PCI DSS-compliant providers.
Chatseeker:
- does NOT store full card numbers
- may process limited payment-related data (e.g., payment tokens, last four digits, billing country)
5. Service Credits
Chatseeker may operate using prepaid service credits.
Credits:
- are NOT money or electronic money
- have no stored monetary value
- cannot be redeemed or withdrawn
- are non-transferable
6. Prices and Taxes
All prices are displayed exclusive of applicable taxes unless stated otherwise.
Depending on your location, the following may apply:
- VAT (EU/EEA)
- UK VAT
- US sales or use tax
7. Subscription and Pricing
Chatseeker offers subscription-based pricing per creator account.
The available plans are:
- Lite: USD 9 per creator account per billing cycle, plus a 15% commission on commissionable revenue
- Pro: USD 69 per creator account per billing cycle, plus a 10% commission on commissionable revenue
- Lite and Pro include the same Service features; no features are withheld based on the selected plan
- the commercial difference between Lite and Pro is the applicable commission rate
8. Plan Changes and Price Changes
Customers may request to switch between Lite and Pro.
Plan changes cannot take effect during the current month or active billing cycle and apply from the next billing cycle.
We may change pricing at any time. Any changes will:
- be communicated in advance where required
- apply from the next billing cycle
9. Automatic Renewal
Subscriptions may renew automatically unless canceled before the renewal date.
By enabling auto-renewal, you authorize Chatseeker to:
- automatically charge your payment method
- renew your subscription at the current rate
10. Refunds
All payments are generally non-refundable.
Refund requests are only considered if submitted within forty-eight (48) hours of the relevant payment, unless applicable law requires otherwise.
A refund is only available if no AI costs have been generated for the relevant account or subscription during that period.
AI usage and related cost signals may be tracked through OpenRouter where OpenRouter is used to provide the relevant AI functionality.
You receive immediate access to the Service upon purchase.
To the extent permitted by applicable law, this constitutes full performance of the Service.
11. Commission Model
Chatseeker does not charge commission on subscription revenue.
Commission applies only to tracked revenue from paid messages, tips, and other chat-generated content processed through the Service.
The applicable commission rate depends on the Customer's active Lite or Pro plan for the relevant billing cycle.
Message and tip activity may be tracked to calculate payable commission.
12. AI Costs for Refund Eligibility
For refund eligibility, AI costs include costs generated through:
- automatically scheduled content processed through our Content Uploader
- AI-generated chat messages
- use of the AI Translator in the Message Dashboard
If any such AI costs have been generated, including costs tracked through OpenRouter, the payment is not eligible for the 48-hour refund policy, except where applicable law requires otherwise.
13. Refund Exceptions
Notwithstanding the above, refunds may be issued at Chatseeker’s sole discretion in cases such as:
- duplicate payments
- proven unauthorized transactions
- technical issues preventing access
- where required by applicable law
14. Right of Withdrawal (EU/EEA)
Where applicable, by purchasing digital services, you expressly request immediate access to the Service and acknowledge that your right of withdrawal may be lost once performance begins.
This applies to the extent permitted by applicable law.
15. Payment Disputes
If you dispute a payment, you agree to first contact Chatseeker to resolve the issue.
We reserve the right to contest chargebacks and recover associated fees and costs to the extent permitted by law.
16. Sanctions and Compliance
Chatseeker may refuse or cancel transactions or suspend access if required by:
- sanctions laws
- anti-money laundering (AML) regulations
- fraud detection systems
17. Relationship to Other Policies
This Policy forms part of the Terms of Service and should be read together with:
- Privacy Policy
- Cookie Policy
- Data Processing Agreement (DPA)
18. Governing Law
This Policy is governed by the laws of Poland.
19. Changes to this Policy
We may update this Policy at any time.
Changes take effect upon publication.
Continued use of the Service constitutes acceptance.
